Position is for a (Part-time) Public Defender for the City of Clarksdale, MS.

GENERAL SUMMARY: Part-Time Public Defender Represents indigent defendants charged with misdemeanor criminal, traffic, municipal code, and environmental violations. Prepares and argues legal motions, conducts legal research, negotiates plea agreements, and represents clients at all stages of court proceedings including arraignments, pre-trial conferences, bench trials, and sentencing hearings. Provides legal guidance to clients and ensures protection of their constitutional rights throughout the judicial process.

SUPERVISION RECEIVED: Works under the general guidance and direction of the Board of Mayor and Commissioners and Municipal Judges.

ESSENTIAL DUTIES AND RESPONSIBILITIES: (Not intended to be all-inclusive):
1. Represents defendants at all stages of City Court proceedings including arraignments, pre-trial hearings, motions, bench trials, sentencing, and probation revocation hearings. Ensures clients are aware of and understand their legal rights, options, and obligations.
2. Reviews and evaluates discovery materials, police reports, prior criminal histories, and other relevant documentation. Conducts legal research and files appropriate motions including suppression motions, mental competency hearings, and other pre-trial motions.
3. Negotiates with prosecuting attorneys regarding plea agreements, diversion programs, alternative sentencing, and other resolutions in the best interest of the client. Consults with clients on plea offers and trial strategy.
4. Participates in all scheduled court appearances for regularly scheduled City Court held on Tuesdays for arraignments and Thursdays for court proceedings beginning at 1:00 p.m. until all matters are concluded. Must also be available for consultation by Court personnel, judicial officers, and clients throughout the week as needed.
5. Coordinates with investigators, treatment providers, probation officers, and other support services to advocate for client needs and sentencing alternatives.
